When not handled with care and compassion, divorce proceedings can quickly become stressful, emotional, and overwhelming for everyone involved. You need to be separated for at least 12 months before you can file your application for divorce in Australia. If you have lived in the same house after separation as part of the 12 months, you will need to file extra information with the Court to show that your marriage has genuinely ended.
It depends on when you have separated. Most of our clients start their property division or parenting matter, and then after they have been separated for 12 months, they make an application for divorce.
You can do your divorce first if you have been separated for over twelve months; however, keep in mind that once the Court makes your final divorce application, you have 12 months to make an application to the Court for a property division if you are unable to agree on how your assets will be divided.
Most divorce applications are decided ‘on the papers’, which means that neither party has to go to Court. All documents are filed to the Court electronically. If a hearing is required, this will be via telephone, and the Court will provide the details to you directly.
You will need to file your divorce application and a copy of your marriage certificate. If you were married in Australia, you can obtain a copy of your certificate from the Registry of Births, Deaths and Marriages in your state. If your marriage certificate is in a language other than English, it must be filed alongside a translation and an affidavit of an accredited translator.
Once you file your application, the Court typically lists it for hearing in around eight weeks, depending on the Court’s processing times. When your application is granted, you can obtain a copy of your final divorce order one month and one day after.
At Pages Family Law, we understand that the divorce process can feel overwhelming—but you don’t have to do it alone. Whether you’re initiating or finalising a divorce, we guide you through negotiations and mediation with clear, compassionate advice on your rights, responsibilities, and the likely outcomes should your matter proceed to court. Our goal is to help you reach a fair and practical resolution to your separation without the stress and cost of litigation.

We don’t just help with divorce arrangements; we provide a full suite of specialist family legal services, guiding you through life’s most challenging transitions. Whether you’re navigating separation, divorce, parenting plans, property settlements, or spousal support, our experienced family lawyers and divorce attorneys are here to support you with clarity, sensitivity, and compassion.
